Third Space Data Rights Policy


1. Purpose

Third Space has a Data Rights Policy (the “Policy”) to ensure clarity in how we support you rights in relation to your personal data under the Data Protection Act 2018 and UK GDPR (“UK Data Protection Laws”).

2. Scope

This Policy applies to all personal data processed by Third Space relating to members, other club users, team members (whether employed, self- employed or a fixed term contractor) and all other individuals.

3. What are your rights?

UK Data Protection Laws give you the following right in relation to your personal data:

  • your right to access means you can ask for confirmation that Third Space processes personal data and copies of any personal data Third Space holds about you
  • your right to rectification means you can request that any personal data that Third Space holds about you, but that is inaccurate or incomplete is corrected by Third Space
  • your right to erasure means you can request Third Space delete personal data that is no longer needed and withdraw your consent to processing unless there is an overriding legitimate interest for Third Space to continue processing your data
  • your right to restrict processing means you can ask Third Space to restrict processing your personal data in some circumstances, including where you think your data is inaccurate or you that your data is being processed unlawfully
  • your right to data portability means you can request your data in a structured, commonly used, machine-readable format where Third Space processes your data automatically based on your consent or contract
  • your right to object means you can object to Third Space processing your personal data based on legitimate interests and to direct marking by Third Space, including profiling based on your personal data relating to marketing
  • your rights related to automated decision making means you have the right not to be subject to decisions based solely on automated processing where those decisions have legal or other significant effects

Third Space may also process special category data. Special category data means sensitive personal information that Third Space hold about you which includes details of any health conditions or medical history you share with us, disabilities, information about your wellbeing and any information you share with Third Space (including any Third Space team members) during health and performance assessments and in connection with personal training.

4. How can you exercise your rights?

You can exercise any of your personal data rights by contacting Third Space in the way that is most convenient for you, including in person and by email. Third Space recommends using one of the following options if you wany to exercise your data rights:

  • by email: data@thirdspace.london; or
  • by post: Third Space Holdings Limited, 1 Bow Churchyard, London, United Kingdom EC4M 9DQ

5. Response

Third Space will contact you by email from data@thirdspace.london to confirm receipt of your data rights request and to verify your identity before responding to your request.

Third Space will normally respond to a data rights request within 1 month of verifying your identity in relation to a valid data rights request. Third Space may extend their response time by an additional 2 months for complicated data rights requests. Third Space will always notify you if we are extending the deadline to respond, and will explain why we are extending the deadline.

6. Fees

Third Space will not usually charge you any fee if you exercise your data rights. Third Space may charge you a fee if you data rights request is manifestly unfounded or excessive.

7. Complaints

Third Space has a Data Complaints Policy which explains what you should do if you are dissatisfied with how Third Space had handled your personal data.

8. Policy review

Third Space monitor and audit our data protection complaint handling procedure to ensure we comply with UK Data Protection Laws. This Policy will be reviewed annually and updated as required. The most recent version of this Policy can be requested from data@thirdspace.london.
